Requirements for Registration Under the Canadian Free Trade Agreement (CFTA)

I. INTRODUCTION

The following information is designed to assist interested persons in understanding the requirements for registration under the CFTA and the issuing of a certificate of practice to practise in the province of Manitoba. This information cannot cover all circumstances and a definite answer with respect to registrability can only be given upon the submission of an application with supporting documents and the required documentation fee.

In any disagreement between this information and the wording of The Regulated Health Professions Act of Manitoba and Regulations thereunder, or any other legislation governing these matters, the terms of the legislation will prevail.

II. WHAT IS THE CANADIAN FREE TRADE AGREEMENT?

The Canadian Free Trade Agreement (CFTA) is an agreement amongst the federal, provincial and territorial governments of Canada. One of its purposes is to eliminate barriers to labour mobility within Canada. The CFTA entitles physicians who have an independent practice licence in another Canadian province or territory to apply as a regulated member full practising class without having to undergo significant additional training, examination or assessment. The applicant must still apply for registration in Manitoba and may not practise in Manitoba using registration or a licence issued by another jurisdiction.

III. REQUIREMENTS FOR REGISTRATION

The usual credentialing requirements apply. The College will still assess the applicant’s fitness to practise, assessments respecting public safety issues, criminal record, and complaints and discipline history, and may refuse registration if it is necessary to protect the public interest.

Additional requirements may be imposed if the applicant has not recently practised medicine in the field in which the applicant is seeking registration and licensure.

The College will assess whether any conditions or restrictions on the candidate’s registration or licence in another Canadian jurisdiction can be accommodated, and registration in Manitoba may be refused if a condition or restriction cannot be accommodated by an equivalent condition or restriction in Manitoba.

Physicians with a provisional/conditional licence in another Canadian jurisdiction may also apply under the CFTA in the regulated member provisional (family practice limited or specialty practice limited) class if there are no conditions or restrictions on the candidate’s licence, or if there are conditions or restrictions on the candidate’s licence that can be accommodated in Manitoba, and if the candidate has undergone an assessment in the licensing province that is acceptable to the CPSM (family practice or specialty practice).

IV. Applicants applying under the CFTA must complete the Application for Medical Registration (AMR). You will be required to submit the following fees at the time you submit your AMR: $200 Medical Council of Canada fee; $210 CPSM Review of Qualifications fee.

V. DOCUMENTATION

If you are registered with physiciansapply.ca, you do not need to submit copies of the documents that are in your physiciansapply.ca profile, but you must select document sharing with the College. If you do not have a physiciansapply.ca profile, you will be required to submit original notarized copies of supporting documents. You will be contacted by the College following submission of your Application for Medical Registration with respect to the documentation that will be required.

Before registration is issued and prior to commencing practice, a recent passport-type photograph and evidence of identity, including evidence that the applicant is legally entitled to work in Canada (Canadian passport/birth certificate; passport and one of the following: permanent resident status, valid work permit, or Canadian citizenship) is required.

It is the applicant’s responsibility to ensure that the documentation is complete.

VI. PROFESSIONAL LIABILITY INSURANCE

Regulated members in the full or provisional class must hold professional liability coverage either as a member of the Canadian Medical Protective Association or carry a policy of professional liability insurance of at least $10,000,000.00 issued by a company licensed to carry on business in the province of Manitoba.

VII. INTERVIEW AND FEES REQUIRED

Once a position has been obtained in Manitoba, and before registration is issued, the applicant will be required to appear for a personal interview. Registration and certificate of practice fees are due prior to commencing practice.

VIII. CERTIFICATE OF PRACTICE (Certificate)

To engage in the practice of medicine, a member must hold a valid certificate of practice entitling the holder to practise in his or her field(s) of practice in accordance with CPSM General Regulation s.2.10(2).

2. Monthly: A certificate for a calendar month or portion thereof may be issued at a reduced fee. This is primarily designed for those doing a locum tenens who will not be practising for more than six calendar months in the certificate fee year.

IX. CANCELLATION [Regulated Health Professions Act (RHPA), s. 48(1) to 52]

A Registrar may cancel a member’s registration or certificate of practice:

(a) If the council has directed the Registrar to cancel a member’s registration when the member’s registration or certificate of practice, or both, have been obtained by means of a false representation or declaration,

(b) If the council has directed the Registrar to cancel a member’s registration when the member has been convicted of an offence that is relevant to his or her suitability to practice;

(c) Upon receipt of proof that the member is deceased;

(d) If the Registrar is satisfied that the registration certificate has been issued in error;

(e) Upon the request of the member.

WARNING NOTICES

The College cannot be responsible for delays in registering persons who have not submitted their application and documents well in advance of arrival in Manitoba. The College cannot be responsible for delays due to incomplete documentation.

Applicants are cautioned that they must not engage in practice in this province until such time as a certificate of practice have been issued.

Applicants should advise referees that their name has been used, and that the application cannot be completed without responses. Therefore, prompt replies to our inquiries would be appreciated. Please ensure that you provide full e-mail or postal addresses of referees.
